General Terms & Conditions of Sale

The present conditions of sale are concluded on the one hand by the company LESSisRARE, with the capital of 45 000 euros, whose registered office is located at 161 avenue Victor Hugo 75116 Paris, registered with the Register of the Commerce and the Companies of Paris under the number 521 789 909 RCS PARIS, hereinafter referred to as "LESSisRARE", and on the other hand by any natural or legal person wishing to make a purchase via the LESSisRARE website, hereinafter referred to as "the customer" or "the buyer" ".

 

1. Object

These conditions of sale are intended to define the contractual relationship between LESSISRARE and the buyer and the conditions applicable to any purchase made through its merchant site.
Any order under a product appearing in the online store site http://www.lessisrare.fr or http://www.lessisrare.com requires consultation and prior acceptance of these conditions of sale.

 

2. Application fields

These conditions govern the sale of products on LESSisRARE's website on the day the order is placed by the customer. They apply to all LESSisRARE ordering methods, whether the order has been placed over the Internet, by e-mail, by telephone, or by post.

 

3. Products marketed on LESSisRARE.fr and LESSisRare.com shops

All offers of products offered on the Site can be shipped worldwide. However some products, can not for various reasons be shipped in some countries. In some cases, the reason will be specified in the product sheet.
Promotional offers are valid only within the double limit of the validity period of the offer concerned and the available stocks.
In case of unavailability of one or more products the customer will be notified by email and he will be refunded immediately if he does not wish another product possibly offered.
In accordance with Article L. 111-1 of the Consumer Code, the Buyer may, prior to his order, take note, on LESSisRARE essential characteristics of the product or products he wishes to order. The photographs, graphics and descriptions of the products offered for sale are only indicative and do not bind the seller.
Any order of Product offered on the Site implies consultation and express acceptance of these terms and conditions of sale, but this acceptance is subject to a handwritten signature from the User. In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001, taken for the application of Article 1316-4 of the Civil Code and relating to the electronic signature, it is recalled that the validation of the purchase order as specified in Article 3.3. hereinafter constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature. It is specified that the User can save or print these general conditions of sale, provided however that they are not modified. The present general conditions of sale are valid as of 15 July 2010. The purchase by email, telephone, or postal mail also implies the acceptance of these Conditions that the buyer acknowledges having previously read, understood and accepted in the conditions mentioned above.
LESSisRARE reserves the right to modify these General and Specific Terms and Conditions of Sale at any time, without notice, it being understood that such modifications will not be applicable to bookings and orders previously accepted and confirmed by the buyer. These conditions apply to the exclusion of any other document.

 

4. Price

The prices listed in the catalog are prices in euros and all taxes included.
LESSisRARE reserves the right to modify its prices at any time, it being understood however that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.
Prices shown on the product sheet do not include shipping and delivery charges. Shipping costs are nevertheless displayed separately on the basket summary. The customer must select the shipping charges corresponding to the shipping area.

 

5. The command

Ability to enter a contract

The purchase of a product located on the sites of the company LESSisRARE not being an act of management of the daily life, in view of the respect of the article 1124 of the civil code, any customer of the company LESSisRARE declares to have the ability to contract under the conditions described below, that is to say, be emancipated minor or have the legal majority and not be protected within the meaning of Article 488 of the Civil Code.
LESSisRARE will confirm to the customer the acceptance of the Order by sending in the 24 hours a confirmation message to the email address that the latter has communicated.
The sale will be concluded only from the sending of said order confirmation. LESSisRARE reserves the right to refuse any Order from a Customer with whom there is or would appear during the processing of an Order a dispute, in particular a dispute of payment.

 

Refusal of an order

LESSisRARE reserves the right not to confirm an order for any reason whatsoever, including in particular to a problem of supply of products, or to a problem concerning the order received or to products difficult to export in certain countries (perfumes , exotic skins, pearls etc.)

The date of the order is deemed to be:
  • the date of validation of payment of the order by the Customer in case of payment by credit card online.
  • the date of receipt of the check or transfer.
Payment deadlines by bank transfer or check

Payment must be made within a period of 8 days following the confirmation of the Customer's order by LESSisRARE. After this date, unless LESSisRARE expressly agrees, the order is canceled.

Shipping fees

Shipping costs are free in mainland France from 36 euros of purchase by delivery by Colissimo or letter followed. Outside mainland France or delivery by express transport (UPS, DHL, Chronopost, Fedex etc ...) please consult our table of shipping costs (see Transport tab at the bottom of each page). These costs will be calculated and indicated to the Customer before the final registration of the order.

Placing an order

The particular Client can place his order with LESSisRARE either via the Internet network on www.lessisrare.fr or by e-mail, by telephone or by post.
When the order is placed by e-mail or by post, the ordering must include the information necessary to treat it in good conditions.

Product availability and delivery times 

Some of the products on LESSisRARE may not be immediately available. Indeed, some products are made by our creative brands who work only on order.
Availability and delivery time estimated products are shown on each product sheet.
The Customer will be informed by LESSisRARE in its order follow-up in case of late delivery. If LESSisRARE can not obtain a product ordered from its suppliers, or if the availability period is one week or more longer than the time indicated in the product sheet, LESSISRARE will notify the customer of the expected delay by email. The latter may then choose to cancel the order, based on this new information without any cancellation penalty is applied for such cancellation of order. No cancellation compensation (other than the full refund of the Order) may also be requested.
In the event of unavailability, LESSISRARE may offer the Customer a Product of equivalent quality or price. The formal agreement of the Customer will then be requested by LESSisRARE before any shipment.

Registration / order confirmation

An email is automatically sent to the Customer to inform him of the registration of his order provided that the email address indicated in the registration form does not contain an error.
This mail serves as confirmation of order if the availability times are validated by our suppliers.
On the other hand, if the deadlines are not validated by the suppliers, this mail will serve as an order registration only when LESSISRARE and the customer agree on a date of availability. LESSisRARE will then send an order confirmation to the Customer.
LESSisRARE does not send an order confirmation by post or fax.

 

6. Payment and security

The accounts of LESSisRARE are domiciled at CIC Victor Hugo Paris.
Payments will be secured by the STRIPE payment system. All the information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. They are also not stored on our computer systems.

Additional security
  • The credit card number is entered on a secure page hosted by the bank, so it is not known to our IT departments ...
  • The card number is never printed entirely on payment slips.

Payments will be made by credit card (CB, Visa, Mastercard, American Express).
The STRIPE platform complies with the PCI DSS (Payment Card Industry Data Security Standard) security standards of Visa and MasterCard.

PCI DSS certification

PCI DSS is a standard written jointly by the Carte Bleue / Visa and EuroCard / MasterCard networks. It includes recommendations to ensure the security of confidential information held by companies, such as credit card numbers. The account of the buyer will be debited only during the validation of the payment of the order and that of the amount of the products sent and the expenses of delivery.

The on-line sale of the products presented in the site is intended for buyers who reside in FRANCE and in the following geographical areas:

Delivery is made by letter followed by Post, Colissimo, UPS, DHL, Fedex, Chronopost or another carrier at the choice of the supplier. The liability of the carrier or the company LESSisRARE can not be engaged in case of impossibility of delivery due to inaccuracy in the delivery address.
Any delays in delivery attributable to the carrier or LESSISRARE do not entitle the customer to claim damages.
Products ordered are transported at the risk of the recipient. Upon receipt of the Products ordered, the customer or the recipient will have to check the proper functioning of the delivered goods.
In the event that one or more of the Products ordered are missing or damaged, the customer or the recipient must make any reservations with LESSisRARE at the time of delivery.
In case of apparent defects, the customer has the right of return under the conditions provided in the instructions for use of the property.
Are considered as force majeure releasing LESSISRARE from its obligation to deliver, war, riot, fire, strikes, accidents, natural disasters and the impossibility of being supplied.
For reasons of availability of the Products ordered, an Order may be the subject of several successive deliveries to the customer.
In the event that the customer would like the Products ordered to be delivered to two different addresses, it will be necessary for the latter to pass 2 Separate Orders.
The delivery charge is shown in the basket summary.
Customs duty: Any order placed on the Site and delivered outside France and the EEC may be subject to taxes and customs duties that are imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the sole responsibility of the Customer and are his sole responsibility. LESSisRARE Company is not obliged to verify and inform the Customer of applicable customs duties and taxes.

The delivery is delivered by hand: the Customer must check the status of the goods delivered and must then sign the acknowledgment of receipt which is worth confirmation of the order.
In case of delivery of damaged or incomplete goods, the Customer may refuse the delivery and mention its reserves on the delivery note.
The Customer must then inform LESSisRARE by e-mail to the address contact@lessisrare.com or by registered mail with Acknowledgment Reception at 161, avenue Victor Hugo, 75116 Paris, requesting a new compliant delivery (the costs being at the expense of LESSisRARE) or cancellation of the sale and its refund.
In case of absence, a notice will be filed for Colissimo and a new passage will be organized. For express transport companies a notice will also be left and a new appointment will be organized.
At the third unsuccessful passage of the express transport company, the cost of the return costs will be charged to the buyer as a deduction from its refund. The address sent for the receipt of the purchase can not be modified during delivery.
Deliveries are Monday through Friday from 9 hours to 18 hours.

 

8. Returns-Exchange-Refund

Provided that the products are still in their original packaging and that they have not been worn or soiled, chipped, damaged or even cleaned, the buyer has a legal right of withdrawal for a period of 14 days to count from delivery. This period is increased to 30 days at LESSisRARE.

The reimbursement is made within 8 days of receipt of the return package at LESSisRARE. This refund will be notified to the customer by email.
For any return, the buyer must send an e-mail to LESSisRARE customer service by clicking on the contact tab at the bottom of each page indicating the product to be returned, the order number and the mention: refund or exchange. The buyer must also specify the reason for the return. A return number will then be returned to him which he will indicate in the return package. The buyer can use the carrier of his choice but his shipment must include traceability.
Note that jewelry rings are only exchangeable (for a different size) and non-refundable and that some of our products (when customized) are NOT refundable nor exchangeable.

If LESSISRARE receives a damaged package in return, LESSISRARE will return it to the buyer who will be required to pay the shipping costs.

In accordance with the “Châtel” law, the buyer will be fully reimbursed for the purchase and the “outbound” shipping costs. (Except express transport and shipment outside of mainland France)

In case of exchange, the "return" costs will be borne by LESSISRARE on the basis of the simple Colissimo rate. They will be refunded by check sent to the customer.

 

9. Garantie

In case of non-compliance of a product sold, it may be returned to the seller who will resume, exchange or refund.
The buyer will inform by email to the address contact@lessisrare.com or by registered letter AR to the address 161 avenue Victor Hugo, 75116 Paris.

 

10. Liability

LESSisRARE in the process of online sales, is held only by an obligation of means: its responsibility can not be committed for damage resulting from the use of the Internet such as loss of data, intrusion, viruses, service breakdown or other unintended problems.
Regarding the non-performance or the bad execution of the contract, LESSisRARE can however exonerate of all or part of its responsibility by proving that it is imputable, either to the consumer, or the fact, unpredictable and insurmountable, of a third to the contract, either to a case of force majeure.
LESSisRARE can not be held responsible for damage of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the Products marketed. The same applies to any modifications of the Products resulting from the manufacturers.
The responsibility of LESSisRARE will, in any case, be limited to the amount of the order and can not be blamed for simple errors or omissions that could have remained despite all the precautions taken in the presentation of products In case of difficulties in the application of this contract, the customer and LESSisRARE reserve the possibility, before any action in court, to seek an amicable solution.

 

11. Protection of personal data: RGPD Law 

The information collected at the end of each order is mandatory, this information is essential for processing and sending orders, preparing invoices and guarantee contracts. The lack of information leads to the non-validation of the order.

Under the General Data Protection Regulation (GDPR), the consumer has several rights with regard to LESSisRARE:

• The right to be forgotten: the right to be "forgotten" in LESSisRARE databases.

• The right of consultation: right to consult the data concerning you.

• The right to limit processing: the right to limit the amount of data processed.

• The right of rectification and addition: right to change personal data.

• The right to automated decision making and profiling: the right to a human look when making decisions.

Your consent: 

By placing an order on LESSisRARE, the customer declares that he is of legal age in his State or province of residence, and that he entrusts us with his consent to allow any dependent minor to use this website.

When the customer places an order, he is obliged to provide us with his personal information, in order to conclude a transaction, schedule the delivery or a return. It is assumed that the customer consents that LESSisRARE collects its information and that we use it for this purpose only.
If we wanted to use their personal information for another reason, for marketing purposes for example, we will ask them directly for their express consent, or we will give them the opportunity to refuse.

LESSisRARE is the owner of the intellectual property rights on the site and the right to disseminate the elements appearing on its catalog and in particular the photographs which it carried out or of which it obtained the necessary authorizations of the persons concerned.
Consequently, the partial or total reproduction, on any medium whatsoever, of the elements composing the site and the catalog, their use as well as their provision to third parties are formally forbidden.
Anyone with a website and wishing to place on his site a simple link directly to the websites www.lessisrare.fr, www.lessIsRare.com or www.lessisrare.com/blog must request permission from LESSisRARE.
An authorization given by LESSISRARE will in no way constitute an implicit agreement of affiliation and will in no case be given definitively.
On simple request from LESSisRARE, this link must be removed.
Any hypertext link to sites www.lessisrare.fr, www.lessisrare.com or www.lessisrare.com/blog using techniques such as "framing" or "in-line linking" is strictly prohibited.

 

13. Evidence

The computerized registers, kept in LESSisRARE's computer systems under reasonable security conditions, will be considered as proof of communication, orders and payments between the parties.
The filing of purchase orders and invoices is done on a reliable and durable support that can be produced as evidence.

 

14. Full contract and voidness

A change of legislation, regulation or court decision making one or more clauses of these Terms and Conditions null and void can not affect the validity of these Terms and Conditions.
Such a change or statement could in no way allow the Customer to not respect these Terms and Conditions.
If a condition was not explicitly mentioned, it would be considered as governed by the practices in force in the sector of distance selling whose companies are headquartered in France.

 

15. No waiver

LESSISRARE's failure to invoke a breach by the customer of any of its obligations could not be interpreted as a waiver of the obligation in question and to take advantage of such breach at a later date.

 

16. Duration and application

These Conditions apply to any purchase made on the site of www.lessisrare.com www.lessisrare.fr The present Conditions, are modifiable at any time by LESSISRARE. The applicable Conditions are those in effect on the date of the order's registration.

 

17. Applicable law

The present conditions of sale on line are subjected to the French law. In case of dispute, the courts of PARIS are competent, notwithstanding plurality of defendants or warranty claim.
